1. Agreement to Terms

These Terms of Service govern your use of the Desknomics website and service, operated by ergonomos CS UG (haftungsbeschränkt), Amtsgericht München HRB 279999. By accessing or using Desknomics, you agree to be bound by these terms. If you do not agree, you may not use the service.

2. Description of the Service

Desknomics is a web-based ergonomic workstation self-assessment platform. It enables users to register workstations, complete ergonomic assessments, receive risk-scored recommendations, download PDF reports, and track their progress over time.

3. Not Medical, Legal, or Regulatory Advice

Desknomics provides informational and educational content based on recognised ergonomic principles and workplace health and safety good practices. The results, scores, and recommendations generated by the platform are indicative only and do not constitute medical, legal, or regulatory advice. They are not a substitute for consultation with a qualified ergonomist, occupational health specialist, safety professional, medical practitioner, or other qualified professional.

Any health concerns should be discussed with an appropriately qualified healthcare professional. Desknomics does not make medical diagnoses and does not guarantee any particular outcome or improvement in health or comfort.

4. Accounts

To use the service, you must create an account using a valid email address. You are responsible for maintaining access to your email address, as sign-in is performed via passwordless magic links sent to that address. You agree to use the service in accordance with applicable law and these terms.

5. Your Data and Content

You retain ownership of the data and content you provide, including workstation information, assessment responses, and uploaded photos. You grant us the limited right to process this data solely to provide and improve the service. You are responsible for ensuring you do not upload personal, confidential, sensitive, financial, medical, or identifying information of others without authorisation.

6. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorised access to the service or other users' data
• Upload malicious files or abuse the service's rate limits
• Interfere with the operation of the service

7. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that results will be accurate or complete.

8. Limitation of Liability

To the maximum extent permitted by law, ergonomos CS UG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the service. Our total liability for any claim arising from your use of the service shall not exceed the amount paid by you for the service, or €100, whichever is lower. Nothing in these terms limits liability that cannot be limited under applicable law.

9. Termination

You may delete your account and all associated data at any time from your account settings. We may suspend or terminate access to the service if you breach these terms. Upon termination, your right to use the service ceases, subject to applicable law and retention obligations.

10. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated through the service. Continued use of the service after changes constitutes acceptance of the revised terms.

11. Governing Law

These terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-law principles.
